New York City Man Charged In Connection With Three-Day Crime Spree, Including Subway Shooting And Bank Robberies | USAO-SDNY

Damian Williams, the US District Attorney for the Southern District of New York; Michael J. Driscoll, the assistant director of the New York Branch of the Federal Bureau of Investigation (“FBI”), and Dermot Shea, the Commissioner of the New York Police Department ( “NYPD”) announced that DAMON BAILEY was arrested in Union Square subway station yesterday, the day after he allegedly shot and killed a train colleague at the station during rush hour. Today BAILEY was charged in a criminal complaint of being a felon in possession of a firearm in connection with the subway shootout and attempted robbery of a deli, involving two banks in Manhattan on October 25, 2021 and October 26, 2021 Guns at gunpoint were robbed in connection with these bank robberies. BAILEY was brought before US Judge Barbara Moses in federal court in Manhattan today.

US Attorney Damian Williams said: “Damon Bailey has allegedly shot and killed a passenger in a crowded subway during a brazen, multi-day armed robbery. We praise the extraordinary work of our law enforcement partners, who quickly linked the many points and safely arrested the suspect. “

FBI Assistant Director Michael J. Driscoll said: “As we claim today, Mr. Bailey was involved in a multi-day gun and violent crime rampage. In doing so, he terrorized several of our neighbors and deprived them of their right to feel safe in their lives. The swift action taken today by the FBI / NYPD Joint Violent Crimes Task Force should remind everyone that we will not tolerate this type of behavior in our city. “

As alleged in the lawsuit filed in federal court in Manhattan today[1]:

Within three days, BAILEY committed two robberies at gunpoint in Manhattan and attempted two more. On October 24, 2021, BAILEY flashed a firearm in his waistband and requested money from a customer at a deli near Grand Central Station. On October 25, BAILEY robbed a bank in Lower Manhattan at gunpoint and attempted to rob a victim on the subway about ten minutes later, then shot the victim when the train pulled into Union Square station during rush hour. On October 26th, BAILEY robbed a second bank in Chelsea at gunpoint. In each of the raids, BAILEY carried a light gray backpack and wore sneakers with a distinctive green toe box and white trims.

After the second robbery, BAILEY got back on the subway, but this time he was arrested and arrested when he arrived at Union Square train station. Due to the proximity of the second bank to the NQR subway line, NYPD officials walked to a south-facing platform of the Union Square subway station and pegged an incoming train to search the cars for someone who was the Description of the robber corresponded. BAILEY, 38, is charged with two bank robberies, with a maximum sentence of 20 years in prison; a criminal charge in possession of firearms, punishable by a maximum sentence of 10 years in prison; and two cases of knowingly using and carrying a firearm during and in connection with a violent crime as well as possession of a firearm to promote a violent crime, the firearm being wielded, for which a mandatory minimum prison sentence of seven years in a row is provided for up to any other custodial sentence towards life imprisonment.

The maximum legal sentences are prescribed by Congress and are provided here for informational purposes only as any conviction of the accused would be determined by the judge.

Mr. Williams praised the excellent coordinated investigative work of the FBI and the NYPD.

This case is being handled by the Bureau’s General Crime Department. U.S. Assistant Attorney Jane Y. Chong leads the indictment.

The allegations contained in the complaint are merely allegations and the defendant is presumed innocent until proven guilty.
