Cherry Creek Man Convicted by Federal Jury for Assault and Tampering with Evidence | USAO-SD

Acting U.S. Attorney Dennis R. Holmes announced that Samuel Francis White Horse, 33, of Cherry Creek, South Dakota, had been found guilty of assault by beating, beating, or wounding and tampering with evidence on a three-day federal court in jury trial Pierre, South Dakota. White Horse was acquitted of charges of complicity in second degree murder, voluntary homicide, attack with a dangerous weapon, and assault with aggravated assault. The judgment was made on June 24th, 2021.

The conviction comes with a maximum sentence of 20 years in federal prison and / or a $ 250,000 fine, three years supervised release, and a special $ 100 assessment to the Federal Crime Victims Fund. A provision can also be ordered.

White Horse was indicted by a federal grand jury on March 9, 2020.

The judges found that on February 12, 2020, White Horse assaulted a man who crashed his vehicle into White Horse’s courtyard by hitting him on the head during a medical emergency. Jerome White Horse, Jr., the defendant’s father, also hit the victim several times on the head with a garden hoe. The victim died a few days later after suffering significant bleeding in the brain. Jerome White Horse, Jr., pleaded guilty and was convicted of voluntary manslaughter. After witnessing his father hitting the victim with the garden hoe, the defendant took control of the gun and hid it under the porch of his home to hide it from law enforcement. The garden hoe was recovered a few days later while a search warrant was being carried out and was found by the South Dakota Forensic Laboratory with the victim’s DNA on the blade and the DNA of Jerome White Horse Jr. on the handle.

The investigation was conducted by the Federal Bureau of Investigation, law enforcement agencies of the Cheyenne River Sioux Tribe, and the South Dakota Division of Criminal Investigation. U.S. Assistant Attorney Cameron J. Cook is pursuing the case.

The sentencing was scheduled for September 20, 2021. White Horse was immediately placed in custody by the US Marshals Service after the jury’s verdict was announced.
