The investigations that led to this SEC lawsuit involve Vuuzle TV, Vumu Music and its film studio and television production company in Dubai. The SEC opened a fraud case against the company and Flynn without soliciting any information from Vuuzle during its investigation.

There were no requests to Vuuzle to voluntarily provide information. There were no administrative summons against Vuuzle. Voluntary inquiries or administrative subpoenas to the conducting business, which are normal hallmarks of a fair regulatory investigation that should precede any SEC enforcement action.

There wasn’t even a Wells Notice to give Vuuzle an opportunity to stop the SEC from filing a case. Undoubtedly, to the consternation of the SEC, Vuuzle has responded to the complaint, denying the SEC’s allegation, conveying that Vuuzle is a real brick-and-mortar company with a state-of-the-art studio in the United Arab Emirates and a functioning facility in the United Arab Emirates Emirates are housed in the Philippines and Las Vegas and employs people in the creative, marketing and programming departments.

Now, the SEC wants this court to imprimatur the unlimited and discretionary use of intelligence by the SEC that the SEC receives in litigation under and subject to the Fed. R.Civ. P. 26 (b) (1) – for purposes far beyond what the SEC itself has previously determined to be unnecessary and irrelevant, during and to advance its investigation.

The SEC and DOJ excitement includes a threat against one of the directors of Vuuzle TV, who is a retired dentist aged 73, Dr. Richard Marchitto. The AUSA Jenifer Weir and the FBI threatened the doctor to close all bank accounts on Vuuzle TV or they would put him in jail.

The fact is that the government has not investigated and there is no evidence to back up their claims. This is Vendetta and a Fraudulent Investigation corrupted by the FBI and SEC that has fingerprints all over the place.

Rather than adhering to the federal civil procedure code that governs all parties in civil litigation, the SEC’s proposed language in a protection order seeks to manipulate the protection order so that the SEC can continue to use litigation discoveries from its own à la carte menu “Routine Uses,” all to the detriment of the Defendants and their ability to defend themselves against the SEC’s allegations.

Vuuzle would prefer to even ban the disclosure of any discoveries to the Justice Department, Vuuzle believes that this is restricted by the language of the two laws mentioned. There is a fundamental lack of fairness and denial of the same protection that allows the SEC to advance the work of the DOJ, where the DOJ is desperately trying to support a criminal case against someone who is not even in its custody, but against the it has made a return public indictment with the apparent purpose of cumbersome denigrating the defendant in SEC civil proceedings.

The case against Mr Ronald Flynn is untrue and false. Vuuzle Media is a real entity while both the SEC and the FBI continue to phone and send letters to share disinformation and false statements in order to shut down the company.

Voluntary inquiries or administrative subpoenas to any company in active business are hallmarks of a fair regulatory investigation that should precede any SEC enforcement action.
