Baltimore, Maryland – A federal grand jury has filed charges against Michael McDonald, 40, of Baltimore, Maryland, of tax evasion for tax years 2016-2018 and failure to file tax returns for tax years 2016-2019. The charges read Returned November 10, 2021 and unsealed today after McDonald’s was arrested. McDonald will appear before US District Judge Mark Coulson for the first time in the US District Court in Baltimore at 1:30 p.m. today.
The indictment was released by the Maryland District Attorney Erek L. Barron; Special Representative Thomas J. Sobocinski, Federal Bureau of Investigation, Baltimore Field Office; and Special Representative Darrell J. Waldon, Internal Revenue Service – Criminal Investigation, Washington, DC Field Office.
According to the seven count indictment, McDonald filed fake W-4 forms for the 2016, 2017 and 2018 tax years for 2019.
If convicted, McDonald faces a maximum sentence of five years in federal prison for any case of tax evasion and a maximum of one year in federal prison for any case in which the income tax return was not filed. Actual penalties for federal crimes are typically less than the maximum penalties. A federal district court judge will determine each sentence based on U.S. sentencing guidelines and other legal factors.
An indictment is not an admission of guilt. A person charged by indictment is presumed innocent unless proven guilty in subsequent criminal proceedings.
US Attorney Erek L. Barron commended the FBI and the IRS-CI for their work in the investigation. Mr. Barron thanked US assistant attorneys Kathleen O. Gavin and P. Michael Cunningham who are pursuing the federal case.
