Department of Commerce Posts Details on EU Tariff Rate Quota and Exclusion Extensions | Arent Fox

BIS has published the following lists, which provide additional guidance on how the tariff quota works and the revised EU import exclusion application process, which will come into force on January 1, 2022.

  1. The list of exclusions granted, which can be extended until 2023. Recall that the announcement of the EU agreement stipulated that the exclusions granted and used in the financial year 2021 (October 2020 to September 30, 2021) by 2 calendar years (until 31st 2023) without the need to reapply. For example, an exclusion granted in February for 50,000 tonnes and used in July 2021 will be carried over for 2022 and 2023 for the same amount of 50,000 tonnes per year.
  2. The list of permitted TRQ volumes by country and product group. The TRQ is awarded quarterly by product group and country according to the principle of “first come, first served”.
  3. A list of the annual steel TRQ categories by HTSUS subtitles.
  4. A breakdown of the annual steel TRQ amounts by quota category and EU member state.
