Court: JS man embezzled funds from Harvest Moon | News, Sports, Jobs

LINDEN – Joseph Rinker, 51, of Jersey Shore is accused of embezzling over $ 300,000 from the Harvest Moon restaurant, convenience store and gas station in Linden, according to the Pennsylvania Central District Attorney.

Rinker, a co-owner of the company, was charged with one-time false tax returns for criminal intelligence.

Acting U.S. Attorney Bruce D. Brandler said Rinker reported no earnings between 2014 and 2017 after embezzling over $ 300,000 in Harvest Moon funds. The total estimated tax loss is $ 64,250.

The case was being investigated by the Internal Revenue Service’s Criminal Investigation Division. US Assistant Attorney Alisan V. Martin is pursuing the case.

The judge imposes a penalty after a guilty finding, taking into account the applicable federal criminal laws and the federal criminal court order.

The maximum federal penalty for the accused is three years imprisonment, one supervised release after imprisonment and one fine.

According to federal sentencing guidelines, the judge must also consider and weigh a number of factors, including the nature, circumstances, and gravity of the offense; the history and characteristics of the defendant; and the need to punish the accused, protect the public, and care for the accused’s educational, professional, and medical needs.

For these reasons, the maximum legal penalty for the offense is not an accurate indicator of the possible penalty for a particular defendant.
